Terms and Conditions


These are the terms and conditions & contract on which we supply the membership plan to you which work in conjunction to our fishery rule book:

  1. Why you should read them. Please read these terms carefully before you submit your payment to us. These terms tell you who we are, how we will provide the memberships to you, how you and we may change or end the contract, what to do if there is a problem and other important information. 
  2. Who we are. We are SWS Fisheries Limited a company registered in England and Wales. Our company registration number is 13665454 and our registered office is at 24 Bridgewater Place, Leybourne, West Malling, Kent, ME19 5QS.
  3. How to contact us. You can contact us by telephoning our customer service team at 07500803930 or by writing to us at fisheries@swscountryside.co.uk, or by post 46 Chancery Lane, London, WC2A 1JE.
  4. How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address or postal address you provided to us in your order.
  5. "Writing" includes emails. When we use the words "writing" or "written" in these terms, this includes emails.
  6. How we will accept your order. Our acceptance of your order will take place when you have made payment for the membership. At which point the contract (our terms & conditions and fishery rule book) will come into existence between you and us.
  7. If we cannot accept your order. If we are unable to accept your order, we will inform you of this in writing. This might be because we have reached our limit on active members, because you have applied to use without a members reference or because of unexpected limits on our resources which we could not reasonably plan for.
  8. Your membership number. We will assign a membership number to your membership plan and tell you what it is when we accept your payment. It will help us if you can tell us the membership number & your full name whenever you contact us about your membership with us.
  9. Products may vary slightly from their pictures. The images of the products on our website & social media platforms are for illustrative purposes only. Although we have made every effort to display the colours & images accurately, we cannot guarantee that a device's display of the colours or images accurately reflects the products we are selling.
  10. Changes to the products. We may make changes to the membership plan during the course of your membership being active with us, we will write to you in any event.
  11. Updates to digital content. We may update or require you to update digital content with our case management system Clubmate
  12. When we will provide the membership. The membership you choose will have the start & end date within the membership plan. 
  13. We are not responsible for delays outside our control. 
  14. When you are permitted to fish. You are permitted to enter site & start fishing once we have received payment in full or in part if you have opted to use the payment plan option.
  15. What will happen if you do not give required information to us? We may need certain information from you so that we can supply the membership to you, for example, your full name, contract details, home address and payment details. If so, this will have been stated in the description on our website or within the Clubmate app. We will contact you in writing to ask for this information. If you do not give us this information within a reasonable time of us asking for it, or if you give us incomplete or incorrect information, we may either end the contract or make an additional charge of a reasonable sum to compensate us for any extra work that is required as a result. We will not be responsible for supplying the products late or not supplying any part of them if this is caused by you not giving us the information we need within a reasonable time of us asking for it. 
  16. Reasons we may suspend the membership to you. We may have to suspend the membership if you break the contract between us and you. 
  17. Your rights if we suspend the supply of the membership. We will contact you in advance in writing to tell you we will be suspending supply of the membership, unless the problem is urgent or an emergency. You will not be liable to any refund or compensation if we suspend the supply of the membership for any period of time. 
  18. We may also suspend supply of the membership if you do not pay. If you do not pay us for the membership when requested, we may suspend supply of the membership until you have paid us the outstanding amounts. We will contact you to tell you we are suspending supply of the membership. 
  19. You can always end your contract with us. You have 14 days from making payment to end the contract between us and you. If you end the contract within the 14 day grace period you will be entitled to a partial refund at our discretion. If you end the contract after the 14 day grace period you will not be liable to any compensation or refund. 
  20. Exercising your right to change your mind (Consumer Contracts Regulations 2013). For most products bought online you have a legal right to change your mind within 14 days and receive a refund.  These rights are under the Consumer Contracts Regulations 2013. 
  21. When you don't have the right to change your mind. You do not have a right to change your mind about the membership plan after the 14 day grace period has passed.
  22. How long do I have to change my mind?: 2 weeks, 14 days (including weekends and bank holidays)
  23. Refunds: We do not offer refunds after 14 days of you making payment for the membership plan. 
  24. Ending the contract where we, SWS Fisheries Limited, are not at fault and there is no right to change your mind. Even if we are not at fault and you do not have a right to change your mind, you can still end the membership plan before the end date, but you may have to pay us compensation as a result of you ending the contract. A contract for services is completed when your membership plan has ended and you have paid for them. If you want to end a contract before it is has ended where we are not at fault and you have not changed your mind, just contact us to let us know. The contract will end immediately, but we may deduct from that refund, reasonable compensation for the net costs we will incur as a result of your ending the contract.
  25. Tell us you want to end the contract. To end the contract with us, please let us know by writing to us at fisheries@swscountryside.co.uk
  26. Returning products after ending the contract. If you end the contract for any reason after products have been dispatched to you or you have received them, you must return them to us. You must either return the goods in person or post them back to us at 46 Chancer Lane, London, WC2A 1JE.  If you are exercising your right to change your mind you must send off the goods within 14 days of telling us you wish to end the contract. Please note we must receive the goods before making any refund. 
  27. Fishery gate keys: a key to gain access to the fishery will be sent to you within 14 days of making payment for your membership. The key is owned by SWS Fisheries and remains so throughout the period of your membership plan and is not a pursuable item. If you chose to end the contract, if you break the contract or if you leave the club and do not renew your membership, we require you to send the key back to us at 46 Chancery Lane, London, WC2A 1JE. We will pursue legal action to reclaim any property of SWS Fisheries Limited.
  28. How we will refund you if you are exercising your rights under the Consumer Rights Act 2013:  We will refund you the price you paid for the membership. However, we may make deductions from the price to reasonably compensate us.
  29. Deductions from refunds if you are exercising your right to change your mind. If you are exercising your right to change your mind, we will deduct reasonable compensation so we are not at a loss as a result of you changing your mind. 
  30. When your refund will be made. We will make any refunds due to you within 7 working days of receiving back any goods upon our request.
  31. We may end the contract if you break it. We may end the contract for a membership at any time by writing to you or notifying you in person if you break any fishery rules, country park bylaws or laws, without giving you any compensation or refund.
  32. You must compensate us if you break the contract: if you break the contract, your membership with SWS Fisheries Limited will be terminated, you will not be entitled to any compensation or refund. 
  33. We may withdraw the membership. We may write to you to let you know that we are going to stop providing the membership. We will let you know at least 30 working days in advance of our stopping the supply of the membership. We will offer a partial refund on the remaining months left within your membership plan if we withdraw the membership.

  35. Where to find the price for the membership plans. The price of the membership (which includes VAT) will be the price indicated on the order pages when you make payment for the membership plan within the Clubmate app. 
  36. We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.
  37. What happens if we got the price wrong? We will write to you to notify you of the error and request any sums paid within 5 working days. If payment is not made within this time frame your membership plan will be suspended. 
  38. When you must pay and how you must pay. We accept payment online within the Clubmate app with all major credit and debit cards & in cash. You must make payment for your membership plan prior to the membership plan start date.
  39. We do not except liability to any lost, stolen or damaged property while on site, SWS Fisheries Limited will not be held responsible or accountable for any lost, stolen or damaged goods.
  40. You fish at your own risk across any sites SWS Fisheries control, we will not be held accountable for any injuries or death. 
  41. How we may use your personal information.  We will only use your personal information as set out in our privacy policy (available on the website)
  42. We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
  43. Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms.
  44. If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
  45. Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the products, we can still require you to make the payment at a later date.
  46. Which laws apply to this contract and where you may bring legal proceedings. These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.

Upon purchase of your membership with SWS Fisheries Limited, you are required to read through these terms and conditions and fishery rule book thoroughly, which is the contract between us and you, you must do so prior to making payment and ticking the consent box. Once you have ticked the box on checkout and made payment you have legally entered a contract with SWS Fisheries Limited and have agreed comply with the contract for the duration of the membership plan.
